Welcome to 3D Face Crystal. These Terms of Service ("Terms") govern your access to and use of the 3dfacecrystal.com website ("Website") and all services offered thereon by 3D Face Crystal ("Company," "we," "us," or "our"). By accessing or utilizing the Website, you ("User," "you," or "your") signify your unequivocal agreement to be bound by these Terms. If you do not concur with any provision herein, you are expressly prohibited from using the Website or its services.

  1. Definitions

1.1. "Website" refers to the internet site located at 3dfacecrystal.com. 1.2. "Services" encompasses all functionalities, products, and offerings provided by 3D Face Crystal via the Website, including but not limited to the creation and sale of custom 3D crystal engravings. 1.3. "User Content" denotes any data, images, text, or other materials that you upload, submit, or transmit to the Website in connection with the Services.

  1. Acceptable Use of Services

2.1. General Conduct: You covenant and warrant that your utilization of the Website and Services shall strictly conform to all applicable local, national, and international laws and regulations. You shall not employ the Website for any unlawful or prohibited purpose. 2.2. Prohibited Content: You are strictly prohibited from uploading, submitting, or otherwise transmitting any User Content that: a. Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable; b. Infringes upon the intellectual property rights, privacy rights, publicity rights, or any other proprietary rights of any third party; c. Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment; d. Constitutes unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation. 2.3. Image Submission: When submitting images for crystal engraving, you represent and warrant that you possess all necessary rights, licenses, consents, and permissions to use and authorize 3D Face Crystal to use such images for the purpose of fulfilling your order. You shall indemnify and hold harmless 3D Face Crystal from any claims arising from your failure to possess such rights. 2.4. System Integrity: You agree not to interfere with or disrupt the integrity or performance of the Website or Services, or the data contained therein.

  1. Intellectual Property Rights

3.1. Company Property: All content, features, and functionality on the Website, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, as well as the design, selection, and arrangement thereof, are the exclusive property of 3D Face Crystal, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. 3.2. User Content License: By submitting User Content to 3D Face Crystal, you grant us a limited, non-exclusive, royalty-free, worldwide license to reproduce, adapt, modify, publish, translate, create derivative works from, distribute, perform, and display such User Content solely for the purpose of providing the Services, including but not limited to creating the 3D model and engraving the crystal as per your order. You retain all ownership rights to your original User Content. 3.3. Product Design: 3D Face Crystal retains all intellectual property rights in the 3D models created from your submitted images, specifically relating to the algorithmic conversion and sculptural interpretation, which are distinct from your original two-dimensional source material.

  1. Limitation of Liability and Disclaimers

4.1. "As Is" Basis: The Website and Services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. 4.2. No Guarantee: 3D Face Crystal does not warrant that the Website will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Website or the server that makes it available are free of viruses or other harmful components. 4.3. Damage Exclusion: To the fullest extent permissible by applicable law, in no event shall 3D Face Crystal, its affiliates, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Website or Services; (ii) any conduct or content of any third party on the Website; (iii) any content obtained from the Website; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage. 4.4. Maximum Liability: In no event shall the aggregate liability of 3D Face Crystal for any claim arising out of or relating to these Terms or the Services exceed the amount you paid to 3D Face Crystal for the specific product or service giving rise to the claim, or one hundred U.S. dollars ($100.00) if no such payment has been made.

  1. Termination

5.1. Termination by Company: We reserve the right to suspend or terminate your access to the Website and Services, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. 5.2. Effect of Termination: Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

  1. Governing Law

6.1. These Terms shall be governed and construed in accordance with the laws of the jurisdiction where 3D Face Crystal is registered, without regard to its conflict of law provisions.

  1. Changes to Terms

7.1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Website after any such changes constitutes your acceptance of the new Terms.
